Terms & Conditions

CEC ENTERTAINMENT IS PROUD TO OFFER ITS GUESTS ITS GAME PASS SYSTEM (“GAME PASS”) THAT ALLOWS YOU TO PLAY GAMES AT PARTICIPATING FUN SPOT ARCADE LOCATIONS IN THE UNITED STATES (“PARTICIPATING LOCATION(S)”).

These terms and conditions (the “Terms & Conditions”) govern all Game Pass cards and their use. Game Pass, including all administration related thereto, is provided by CEC Entertainment Concepts, L.P. or its affiliates, parents, or subsidiary companies (collectively “CEC,” “we,” “us,” “our,” “ours”). By purchasing, recharging, or using Game Pass, you agree to be legally bound by these Terms & Conditions, and your use shall be subject to these Terms & Conditions, as they may be amended from time to time, without further notice to you. You can also obtain the latest version of these Terms & Conditions at the cash register at participating locations.

General Information

A Game Pass is a card with a radio frequency identification chip which, depending on the price of the game and the amount of points remaining on the card, can activate the selected game inside CEC. Each game located at Participating Locations requires a specified number of Play Points on the Game Pass to play the Game(s). The Play Points required to play each Game will be displayed on the card reader located on each Game.

The Game Pass can be used only at Participating Locations.

CEC IS NOT RESPONSIBLE FOR LOST, STOLEN OR DAMAGED GAME PASS CARD CONTAINING PLAY POINTS OR TIME.

ANY RESALE OR OTHER TRANSFER OF A GAME PASS FOR CONSIDERATION WILL RENDER THE GAME PASS AND ASSOCIATED PLAY POINTS BALANCES VOID AND SUBJECT TO CANCELLATION.

YOUR GAME PASS IS NON-REFUNDABLE AND WILL NOT, UNDER ANY CIRCUMSTANCES, BE REDEEMED FOR CASH, EXCEPT WHERE REQUIRED BY LAW.

We reserve the right not to accept a Game Pass or otherwise limit use of the Game Pass if it believes the use is unauthorized, fraudulent or otherwise unlawful or violates these Terms & Conditions.

You will not be sent statements of itemized transactions involving your Game Pass.

Purchasing a Game Pass

Purchasing Game Pass requires an activation fee of US$1.00 per Game Pass card.

You can obtain a Game Pass in three ways (note that all sales and use tax is included in your Game Pass purchase):

  • Game Pass Kiosk.   You may purchase Game Pass by simply following the on-screen prompts at the kiosk; or
  • At the Cashier Register.  You may purchase a Game Pass by either a credit card, CEC gift card or cash from authorized CEC employees, including but not limited to Cashier or Manager (collectively, “Authorized Employee(s)”).

Adding Play Points or Time to Your Game Pass Cards

You may add Play Points to your Game Pass at a kiosk or cash register by paying with cash, or credit/debit cards. Some amounts are not available at a kiosk, so please see an Authorized Employee at a Participating Location. The billing descriptor you will see on your credit/bank statement will be portrayed as “CHUCK E CHEES PLAYPASS”

Agreement to Contact Us.  We are eager to offer the best customer experience possible. Playing a Coin Action Game

If a Participating Location offers any Coin action Games (e.g., Smokin’ Token), such games can be played by tapping your Game Pass on the Game’s card reader and the requisite points will be deducted from your card and a token will be dispensed from the Game so you can play the Game.

Play Points do not expire

The Play Points you purchase do not expire, are not subject to a maintenance fee and are stored on your Game Pass.

Combining Play Points from Multiple Game Pass Cards

You may combine Play Points from any number of Game Pass cards onto one Game Pass. The Game Pass card used to transfer Play Points to another Game Pass will contain a zero balance after the transfer but will remain active to allow for additional recharges with no additional fee.

Checking Your Play Points Balance

Your Play Points balance displayed at each Game only shows your Play Points balance for the Play Points type used and may not reflect your entire Play Points balance on your Game Pass.

You may check your Play Points balances by going to an Authorized Employee, kiosks throughout Participating Locations or on the Game Pass page on our website.

When the display window at the Game reads “Low Balance,” this means that the Game costs more Play Points than remain on your Game Pass; however, you may have enough Play Points to play another Game that requires fewer Play Points to play. If you do not have enough Play Points on your Game Pass to play any Game on the Game List provided, you can recharge your Game Pass or transfer the remaining balance to another Game Pass.

E-Tickets

The tickets you win by playing ticket dispensing games will automatically be added to the Game Pass card used to play those games (“E-Tickets”). You simply take your Game Pass card to the Merchandise Counter to redeem for prizes. Based on pricing and availability of merchandise in the Merchandise Counter at Participating Locations, you may not have enough E-Tickets to redeem for any item. You may also have E-Tickets remaining after redeeming for prize(s) from the Merchandise Counter that are insufficient to purchase additional items. Your unredeemed E-Tickets never expire and may be saved for future use. E-Tickets do not have a cash value and may not be refunded or exchanged for cash, nor are they transferable. E-Tickets have no maintenance fee and can be used at any Participating Location; however, they are not valid in the online store.

Cancellation

CEC may suspend or terminate your Game Pass and revoke or limit any or all of the rights and privileges granted to you at any time without notice, liability, reimbursement or compensation. Termination may result from your fraudulent or unauthorized use of the Game Pass or violation of these Terms & Conditions. If we terminate your card with cause, all Play Points will be voided and may not be used. You will receive no compensation from us for voided Play Points. If we terminate your Game Pass without cause, we will refund or issue store credits equal to the balance of Play Points purchased/held in your Game Pass account less any amounts that you may owe CEC.

Billing Errors and Corrections

We reserve the right to correct the balance of your Game Pass if we believe that an error has occurred. If you have questions regarding your transaction history, or if you dispute any transaction or correction that has been assessed against your Game Pass, please call Guest Relations at 1-888-778-7193, Monday – Friday from 8 a.m. to 5 p.m. CST, or online on our contact us page.

Choice of Law

These Terms & Conditions and your use of a Game Pass shall be governed by and construed in accordance with the laws of the State of Texas notwithstanding any conflict of law rules.

Arbitration Rights/Waiver of Rights

Any dispute or claim made by you against us (or against any of our subsidiary, parent or affiliate companies) arising out of or relating to these Terms & Conditions or your use of your Game Pass (whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory) will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under the AAA Commercial Rules and Consumer Related Supplementary Procedures (except that Rule C-4 related to the appointment of an arbitrator will not apply and the arbitrator will be chosen under Rule R-11) before one (1) neutral arbitrator licensed to practice law for at least fifteen (15) years at the AAA offices nearest the location where you purchased your Game Pass, except that (a) you may take claims to small claims court if they qualify for hearing by such a court, or (b) you or we may choose to pursue claims in court if the claims relate solely to the collection of any debts you owe to us. However, all claims (including those claims that are subject to arbitration and those claims that can be prosecuted in a court of law and regardless of whether the claim is brought in an arbitration or in a court of law) must be brought on an individual basis and not as a plaintiff or class member in any purported class or representative proceeding, and you hereby waive any claims for punitive damages and any right to pursue claims on a class or representative basis.
